Mobile Messaging Terms and Conditions

Friends of Rebecca Amidon (“We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), subject to these Mobile Messaging Terms and Conditions (the “Terms”). If you do not wish to continue participating in the Program or no longer agree to these Terms, you can reply “STOP” to any mobile message from Us in order to opt out of the Program.

User Opt-In

The Program allows users to receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through online enrollment forms or by texting a keyword to 765-702-9003 or any successor short code or long code to opt into the Program.

Regardless of the opt-in method you used to join the Program, you agree that these Terms apply to your participation. The mobile messaging service used by Us requires human intervention for messages to be initiated and is not sent using an automatic telephone dialing system (“ATDS” or “autodialer”). Nevertheless, by participating in the Program, you agree to receive autodialed mobile messages and understand that consent is not required to make any purchase or donation.

Program Description

Without limiting the scope of the Program, users who opt in can expect to receive messages concerning Friends of Rebecca Amidon, including campaign updates, event information, volunteer opportunities, and messages may include requests for donation.

Cost and Frequency

Message and data rates may apply. The Program involves recurring mobile messages, and additional messages may be sent based on your interaction with Us. Message frequency may vary.

User Opt-Out and Additional Commands

To opt out (discontinue participation), reply “STOP” to 765-702-9003 or to any mobile message from Us. This is the easiest and preferred method.

You may receive a confirmation message after opting out.

“QUIT,” “END,” “CANCEL,” “UNSUBSCRIBE,” or “STOP ALL”

MMS Disclosure

The Program will send SMS messages if your mobile device does not support MMS messaging.

Warranty Disclaimer

We are not liable for any delays or failures in message delivery. Delivery is subject to effective transmission by your wireless provider and is outside of Our control. T-Mobile is not liable for delayed or undelivered messages.

We will only use information you provide to transmit your messages and respond when necessary.

We do not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or customer information collected through the Program to any third party.

We may disclose information as required by law, regulation, or to protect our rights.

By participating, you agree to provide accurate and truthful information.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Program, such dispute shall be resolved by binding arbitration administered by JAMS.

Governing law: State of Washington
Federal Arbitration Act applies

Each party agrees:

Disputes will be handled individually (no class actions)
Jury trial rights are waived
Arbitration decisions are final and binding

Costs and attorney’s fees may be awarded to the prevailing party.

Miscellaneous

You represent that you have the authority to agree to these Terms. If any provision is found unenforceable, the remaining provisions will remain in effect.

We reserve the right to update these Terms at any time. Continued participation in the Program constitutes acceptance of any changes.
